Kiddos Quest
Kiddos Quest — Terms of use.
Choose your region where available to read your app’s policy.
Effective Date: July 23, 2026 Last Updated: October 11, 2026
These Terms of Use ("Terms") are a legal agreement between Kiddos LLC ("Kiddos," "we," "us," or "our") and the adult who downloads, purchases, or permits use of Kiddos Quest ("you").
Kiddos Quest is a parent-led, camera-based real-world finding game for families with children age 5 and older. A child cannot enter into these Terms. By selecting I Agree in the App's adult acceptance flow, you accept these Terms for yourself and confirm that you are legally able to do so. If a child uses the App, you must be the child's parent or legal guardian, or an adult caregiver authorized by them to supervise that use. Permission to supervise does not itself give a caregiver authority to waive a child's legal rights.
If you do not agree to these Terms, do not use Kiddos Quest.
An adult must actively play alongside the Child throughout every quest. Before starting, check and secure the play area. Stay close, watch the Child and the surroundings continuously, and stop play whenever you cannot supervise. No clue, recognition result, safety reminder, or parent gate means that Kiddos has checked the environment or that an activity is safe. Read Sections 2, 4, 5, and 18–20 before accepting: they explain your responsibilities, physical risks, the limited release of your own claims, liability limits, and indemnity.
1. Definitions
For these Terms:
- App means the Kiddos Quest iPhone and iPad application.
- Child means a minor who uses the App with an adult's permission and supervision.
- Content means the App's quests, target lists, instructions, artwork, images, characters, text, audio, music, visual effects, software, and other materials.
- Kiddos Apps means applications offered by Kiddos LLC, which may change over time.
- Kiddos+ means an optional subscription that may provide premium access across eligible participating Kiddos Apps.
- Subscription means a paid, auto-renewable plan offered through Apple's App Store.
- Parent Controls means the App's adult-facing settings, subscription, legal, support, and external-link area protected by a parent gate.
- Reward Gallery means the App's local gallery of Kiddos World character portraits that may become available as quest points are earned.
2. Adult Acceptance And Child Use
The App presents these Terms before its final I Agree action. That action signifies agreement to the complete Terms, including Sections 4 and 18–20, rather than only the short safety summary. You may cancel instead of accepting. Passing a parent gate alone does not accept the Terms. If another adult will supervise, you must make these safety requirements available to them and ensure that they agree to follow them before handing over supervision. A handoff does not permit an interruption in supervision.
The App requires parent-led family co-play. A parent or legal guardian, or a responsible adult caregiver authorized by them, must be physically present and actively play alongside the Child for the whole quest. Remote monitoring, being elsewhere in the home, or completing a parent gate is not sufficient. The supervising adult must inspect and secure one clear play area, start the quest, stay close enough to intervene immediately, and decide whether each movement within that area is safe. The Child may explore only inside that adult-approved area, with the screen down while moving and only after stopping to look at the screen or aim the camera. You are responsible for:
- reviewing these Terms and the Privacy Policy before allowing a Child to use the App;
- deciding whether the App, a particular quest, and the physical setting are appropriate for the Child;
- continuously watching the Child and the surroundings, actively playing with the Child, and remaining close enough to intervene immediately;
- controlling the device, Apple account, purchases, permissions, and Parent Controls; and
- stopping play if the Child is uncomfortable, distracted, unsafe, or using the App in an unintended way; and
- ending the quest and securing the device before leaving, attending to another task, or otherwise becoming unable to supervise continuously. Another adult may take over only after accepting these responsibilities and checking the area.
By default, the App shows a rules screen before each quest and, after Start, requires an adult to pass the parent gate before the camera opens. This includes another same-story round started with Continue. Parent Controls lets an adult turn off either repeated step independently. It also lets an adult turn off Check Again for Replays, so Continue after a completed Story Adventure can begin the next round of that same story without repeating either enabled launch step. This replay preference does not bypass checks for a fresh start from Home, Quest Collection, Siri, or a deep link. Turning off either step, or turning off replay repetition, does not make solo play appropriate, approve a physical setting, remove the adult's duty to check the area and supervise, or change any responsibility in these Terms.
A parent gate helps separate child gameplay from adult actions, but it does not replace adult supervision or device-level purchase controls. Passing a gate records only that someone answered the displayed question; it is not proof that the person is a parent or that the setting is safe.
3. License To Use The App
Subject to these Terms and Apple's applicable rules, Kiddos grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use the App on Apple devices that you own or control for private family, household, or individual educational use.
This license permits access through Apple's Family Sharing or volume-purchasing arrangements where allowed by the Apple Media Services Usage Rules. It does not expand the subscriptions or content included with a particular purchase.
The App is licensed, not sold. Kiddos and its licensors retain all rights not expressly granted to you.
Use by a school, childcare provider, library, business, or other organization requires an authorized adult and remains subject to these Terms. Commercial redistribution, public exhibition, resale, or operation as a paid service requires our prior written permission.
4. Physical Safety
Kiddos Quest asks a Child to look for real objects. The App is not a safety system and does not know whether a place, route, object, person, or activity is safe.
Using a camera while moving can distract a Child from floors, furniture, people, traffic, and other surroundings. This creates foreseeable risks including trips, falls, collisions, cuts, property damage, and other injury. The App cannot detect or warn about those hazards.
You must choose a safe play area and keep the Child appropriately supervised. Do not allow use:
- while the Child or supervising adult is driving, cycling, crossing a street, or operating equipment;
- while walking near traffic, parking areas, stairs, balconies, pools, open water, fires, kitchens in active use, construction, crowds, or other hazards;
- while running or in a way that asks the Child to climb, jump, rush, run away from the adult, enter a restricted area, touch an unknown object, or approach a stranger;
- to scan faces, bodies, identification, tickets, payment cards, mail, screens, private documents, or personal information; or
- where camera use is prohibited, intrusive, or inconsistent with another person's privacy.
The launch catalog includes only targets with an explicit safety review. Car and construction packs are not available in the launch catalog. Story Adventures may invite the Child to search within the clear area that the adult has checked. Individual Practice Finds may instead require the Child to remain in the current safe position; the displayed rule and hint control. When a target is limited to a toy or picture, do not seek a real animal, vehicle, machine, tool, or hazardous object.
By default, before each quest, the App displays the same child-readable rules and the adult's role. The rules screen also displays place-specific adult precautions for Kitchen, Restaurant, Waiting Room, Cafe, Airport, Garden, Beach, Hike, Park, School, Animals, Grocery, Zoo, Aquarium, and Farm quests. Tapping Start then leads to the default per-quest parent gate described in Section 2. An adult may independently disable the repeated rules screen or repeated math check in Parent Controls. When a step is disabled, the App proceeds to the next enabled checkpoint. Check Again for Replays is also on by default. When an adult turns it off, only the immediate same-story Continue path after a completed Story Adventure skips both optional launch checkpoints; every fresh start keeps the adult's other selected checkpoint settings.
These preferences do not disable camera safety guidance, motion pausing, face vetoes, or any adult duty described in these Terms. The rules screen, its place-specific precautions, and the parent gate do not mean that Kiddos inspected or approved the environment. Whether or not either repeated step is enabled or repeated for a same-story round, the supervising adult must make a fresh safety decision for that place and moment before every quest. Kiddos Quest is not for solo play by a young Child.
Follow the displayed play-area instructions and any stricter precautions required by the actual surroundings. The Child must keep the screen down while moving and stop before looking at the screen or aiming. Use Different clue in Story Adventures or Skip where offered if a target is unavailable, inappropriate, private, outside the approved area, or unsafe. If there is no suitable alternative, end the quest. Adult judgment always takes priority over an App prompt.
Before every play session, the supervising adult must check that the play area and any permitted walking path are level, well lit, clear of trip hazards, and far from roads, stairs, water, moving vehicles, sharp objects, hot surfaces, and other dangers. Remove obstacles and secure access to hazards. Choose objects that can be shown safely from an ordinary standing or seated position. Do not let a Child move furniture, open cupboards, reach out of windows, climb, or handle an object to satisfy a clue. The adult must also consider the Child's abilities, comfort, and ability to carry the device safely. Hold the device or choose stationary play when appropriate, and stop if safe participation is not possible.
During play, the Child must stay within that checked area and close to the supervising adult, walk rather than run, keep the screen down while moving, and stop before looking or aiming. The adult must keep checking for people, pets, obstacles, and other changing conditions. A suggested object, story setting, or likely-nearby clue is never permission to leave the area, go outside, enter another room, or approach a hazard. If the family chooses a different play area, end the quest and check the new area before starting again. No points, reward, timer, or story ending justifies taking a risk.
By default, the App presents a short safety reminder before every quest, including a same-story replay. Parent Controls may disable its repeated presentation entirely or keep it for fresh starts while skipping it on consecutive replays through Check Again for Replays. When it is shown, you may use Back to cancel instead of starting. Whether or not it is shown, you must follow the safety rules in these Terms and must not permit unsafe or unsupervised play. The reminder does not inspect the environment, guarantee safety, or replace adult supervision.
If the App moves to the background during a quest, the active quest ends and the App returns to Home. This reduces unattended or resumed camera play, but it is not a safety guarantee and does not replace the adult's duty to stop play immediately when needed.
During camera play, the App may use transient on-device motion signals to pause recognition and display Stop. Then look. when the device appears to be moving quickly. This is an additional reminder only. It may miss running or other unsafe movement, may activate during safe movement, and cannot determine whether the Child or environment is safe. You must not rely on it instead of supervision or the safety rules above.
Adult Acknowledgment, Assumption Of Risk, And Limited Release
By allowing a Child to use the App, you acknowledge that moving while carrying a device or looking for objects can involve distraction, trips, falls, collisions, dropped devices, and contact with unsafe objects or surroundings. Injury or property damage can occur even when recognition succeeds or a reminder does not appear. You voluntarily choose whether and where to play and accept responsibility for checking and securing the environment, actively playing alongside and continuously supervising the Child, enforcing these rules, and stopping unsafe play. Kiddos does not inspect the play area, provide a supervisor, monitor the Child remotely, or provide emergency assistance.
Limited release of your own claims. To the fullest extent permitted by law, you assume those risks and release Kiddos and its officers, directors, employees, and agents from your own legally waivable claims to the extent caused by hazards in the environment you choose, your inadequate supervision, your misuse of the App, or your failure to follow these warnings. You decide whether a suggested activity can be performed safely and must decline it when it cannot. A clue does not instruct you to disregard these responsibilities.
This limited release is not a blanket release for every injury or a representation that all risks are under your control. It does not release liability for Kiddos's fraud, willful misconduct, gross negligence, unlawful conduct, or any other liability that cannot lawfully be released. It does not purport to waive a Child's independent rights where you cannot legally do so. Neither your acknowledgment of risks nor a parent-gate answer establishes that an injury was your fault. The exclusions and limitations in Sections 18–20 apply only to the extent permitted by applicable law.
5. Camera Recognition And Gameplay Limitations
Camera analysis runs on the device and may evaluate familiar objects, broad colors, and other app-selected visual properties to make real-world finding playful. It may still be delayed, unavailable, or incorrect because of lighting, camera angle, motion, device capability, object variation, occlusion, or limitations in Apple's on-device technologies.
Kiddos does not guarantee that the App will recognize every object, recognize an object consistently, or reject every incorrect object. A visual or audio response from the App is not proof that an object is safe, suitable, authentic, or correctly identified.
Parent Controls includes a New Finds Each Session setting, which is on by default and may be turned off by an adult. When enabled, the App keeps a small non-image signature in memory during the current app session and may ask the Child to pick another object when a later candidate appears to be the same object for the same color. This feature may occasionally treat a genuinely different but visually similar object as a repeat or fail to recognize the same object. Turning it off or clearing quest history deletes the signatures. They also disappear when the app process ends; leaving it temporarily in the background is not necessarily the same as ending the process. They are not written to persistent storage. No photo, crop, raw recognition label, room, or location is stored for this feature. Additional details appear in the Privacy Policy.
If recognition is not working, use Different clue in Story Adventures or Skip where offered, or stop the quest. Adjust the view only while stationary and within the adult-checked area. Do not take risks to make recognition succeed.
Kiddos World And Reward Gallery
Kiddos World characters and artwork may appear on place cards, safety reminders, onboarding, subscription information, the quest browser, and the Reward Gallery. Characters are fictional visual companions. Their presence does not mean that a physical place, object, route, or activity is safe, supervised, endorsed, or suitable for a particular Child.
The Reward Gallery may unlock character portraits according to the local quest score. Gallery portraits, scores, unlocks, and related progress:
- are cosmetic App features with no cash, resale, exchange, or real-world value;
- are not currency, property, prizes, sweepstakes entries, or transferable rights;
- do not create ownership of Kiddos characters or artwork;
- may be reset when quest history is cleared or the App is deleted; and
- may change, be rebalanced, replaced, or become unavailable in a future App update.
The Reward Gallery is intended as a calm record of play. It does not use random paid rewards, competitive rankings, streak pressure, or a public social profile.
6. Adaptive Stories And Local Automated Selection
Story Adventures use an app-authored story graph and a closed catalog of reviewed everyday object concepts. The App uses temporary on-device visual evidence to choose later clues. A separate stationary-camera check must confirm the requested find. Moving glimpses and observations from elsewhere in the frame can help plan a future clue but cannot complete it. Observed objects may become later clues after the applicable freshness and gameplay checks. The App may also suggest an object inferred to be likely nearby from several observations across successful searches; that is a guess, not a claim that the object was seen.
The App may temporarily infer a broad setting from visual evidence to help rank approved clues. That inference can be wrong: a flower, tree, toy, picture, or other object does not establish where the family is or whether an area is safe. The App does not determine the family's geographic location or provide navigation, and does not save a map or inferred room profile in quest history. Every suggested clue remains subject to the adult's checked play-area boundary and safety decision.
Ordinary Story Adventures ask for reviewed colors, printed characters, or eligible approved objects. Some clues require a short search interval and a changed camera view before they can be verified. This does not require walking, leaving the approved area, or completing a clue that the adult considers unsuitable. Different clue replaces the current unresolved clue without recording a find or advancing the story. Completed clues remain unchanged; future clues may be replanned. Nearby suggestions and automated selection never override the safety rules in Section 4.
After the stationary verifier confirms a requested Story object, the App may keep a bounded on-device record of that app-authored target identifier, its find count, and last-found date to reduce near-term repetition among future approved prompts. This record excludes camera labels, images, inferred surroundings, colors, skipped or replaced clues, and resolved story routes; it is capped at 96 identifiers, expires entries after 180 days, and is cleared with quest history.
Practice Find sequences, including New Set, use deterministic local planning restricted to app-approved targets. On eligible iOS 27 devices, Story Adventures use Apple Intelligence scene assistance by default to help select later reviewed clues, as described in the Privacy Policy. This processing stays on device, does not save or upload camera images or scene descriptions in release builds, and does not generate child-facing dialogue. It requires the supported model to be available; the existing on-device planner continues on iOS 26 or when assistance is unavailable. Practice sequences remain deterministic. For unresolved object or exact-color clues in Story Adventures or Practice, supported devices may also use a slower on-device image check against the requested object or a substantial visible patch of the requested color. Recognizable toys and miniatures may satisfy object clues; multicolored objects and printed illustrations may satisfy color-only clues. This check respects the clue restrictions, shares one model-request slot with scene assistance, and contributes only short-lived evidence to the normal stationary hold-to-confirm process. Colors retain their fast pixel detector alongside this second opinion; printed characters retain their dedicated detector. Scene suggestions and recognition results can be wrong and do not replace adult judgment. Internal scene logging and model-comparison tools remain development-only.
Automated selection and adaptive branching may not always produce the most suitable sequence for a particular Child or setting. You remain responsible for reviewing the play area and skipping anything unsuitable.
The App does not send Practice selection inputs or outputs to a generative-AI provider. Additional details appear in the Privacy Policy.
7. Siri, Shortcuts, And Deep Links
The App may provide Siri, Spotlight, Shortcuts, or deep-link actions to choose or start a quest and to open Parent Controls. Apple platform availability and interpretation may vary. An automated command may open the App or prepare a quest, but it does not remove subscription limits, camera permission requirements, safety responsibilities, or the Parent Controls gate.
You are responsible for configuring Siri and device access appropriately for your family.
8. Entertainment And Educational Purpose
Kiddos Quest is provided for general entertainment and informal learning. It is not medical, psychological, developmental, occupational-therapy, behavioral, safety, diagnostic, or professional educational advice.
Kiddos does not promise that the App will produce a particular educational, developmental, emotional, behavioral, or health outcome. Consult a qualified professional for advice about a Child's health, development, accessibility, or learning needs.
9. Privacy
Use of the App is also governed by the Kiddos Quest Privacy Policy, available in Parent Controls and at:
https://www.kiddos.ai/quest/privacy-policy
Core gameplay does not require a Kiddos account. Camera processing occurs on the device. The App does not include third-party advertising, behavioral tracking, or third-party analytics SDKs.
Do not use the App to capture or expose another person's private information, and do not send a Child's personal information in a support request.
10. Parent Controls And External Services
Purchases, subscription management, legal information, support, App Store links, and other external destinations are intended for adults and are placed behind the parent boundary. The one-time first-launch onboarding is an adult-facing setup exception: its Kiddos Family link opens the App Store bundle directly because the parent is already completing onboarding. After setup, onboarding can be reopened only from parent-gated Parent Controls.
If an adult chooses to open Apple, a website, email, or social platform, that third party's terms and privacy practices apply. Kiddos is not responsible for a third-party service's content, availability, security, policies, or independent actions.
11. Free Access, Subscriptions, And Kiddos+
11.1 Free Access
The App includes three free play days, shared by Story Adventures and Practice. A local calendar day counts only when an admitted quest has its first verified successful find; setup, cancellation, and days without successful play do not count. The quest's start day is used if that quest crosses midnight. You may start more quests on each counted day, and an admitted quest may finish. Starting a quest on another day after all three days have been used requires Premium access. Clearing quest history does not reset these days. Existing installations moving from the former quest-count allowance receive a fresh three-day sample.
These free play days are provided by the App without starting a subscription and are separate from any Apple subscription trial or introductory offer. They do not automatically renew or create a charge. A purchase is not required to review Parent Controls, legal information, or available subscription terms.
11.2 Available Plans
Depending on region and availability, Kiddos may offer monthly or yearly Kiddos Quest access and a yearly or other Kiddos+ plan. The purchase screen shown by Apple and the App at the time of purchase controls the current product, price, billing period, trial, introductory offer, eligibility, and included access.
Kiddos+ may provide access to eligible premium features in participating Kiddos Apps. Participating apps, features, regions, and content may change. Kiddos+ does not promise that every current or future Kiddos App or feature will always be included.
11.3 Apple Billing And Renewal
Subscriptions are purchased and managed through Apple's App Store using the adult's Apple account. Apple handles payment authorization, billing, taxes, renewal, cancellation, purchase restoration, and refund decisions.
Unless the purchase screen states otherwise, a Subscription automatically renews for another billing period unless the adult cancels it through Apple before renewal. The adult can review or cancel an active Subscription in the Apple account's subscription settings. Deleting the App does not cancel a Subscription.
Kiddos does not receive full payment-card details and cannot directly change an Apple account, charge, refund, trial eligibility decision, or billing setting.
11.4 Trials And Offers
A trial or introductory offer, when available, is governed by the terms displayed by Apple. Eligibility may be limited by Apple account, subscription group, region, prior use, or other Apple rules. Unless canceled before the trial converts as described in the purchase flow, Apple may charge the displayed Subscription price.
11.5 Refunds
Refund requests must be submitted to Apple and are subject to Apple's policies and applicable consumer law. Nothing in these Terms limits a mandatory right to a refund, cancellation, remedy, or cooling-off period that cannot legally be waived.
Apple refund information is available at:
https://reportaproblem.apple.com/
11.6 Entitlement Sharing
Kiddos+ access may use Apple's iCloud/CloudKit and a shared Kiddos app group so participating Kiddos Apps can recognize subscription entitlement metadata. Availability may depend on Apple services, the device's iCloud configuration, connectivity, regional availability, and a current verified entitlement. Quest progress and camera information are not shared through Kiddos+.
12. Acceptable Use
You may not, and may not help another person to:
- use the App unlawfully or in a way that violates another person's rights, safety, privacy, or property;
- use the App to identify, assess, or profile a person, or direct it at faces, bodies, or private information;
- copy, reproduce, distribute, sell, rent, sublicense, publicly display, or commercially exploit the App or Content except as expressly permitted;
- reverse engineer, decompile, disassemble, bypass, or attempt to derive source code except to the limited extent applicable law expressly permits;
- defeat Parent Controls, purchase controls, subscription checks, access limits, safety controls, or security features;
- use bots, scraping, automated extraction, or similar tools to access or extract the App or Content;
- introduce malware, interfere with operation, overload systems, or attempt unauthorized access; or
- remove copyright, trademark, attribution, or proprietary notices.
13. Intellectual Property
The App and Content are owned by Kiddos or its licensors and are protected by intellectual-property laws. Kiddos Quest, Kiddos AI, Kiddos+, Kiddos LLC, related logos, characters, product names, designs, and trade dress are proprietary to Kiddos LLC.
No right to use Kiddos names, marks, characters, artwork, audio, target catalogs, software, or other Content outside the App is granted unless Kiddos provides written permission.
Third-party software, frameworks, symbols, and other materials remain the property of their respective owners and may be governed by separate license terms.
14. Feedback
If an adult voluntarily sends ideas, suggestions, or product feedback, the adult grants Kiddos a worldwide, perpetual, irrevocable, royalty-free, transferable, and sublicensable license to use that feedback for any lawful purpose without compensation or obligation. This does not give Kiddos ownership of personal information in the message; personal information remains governed by the Privacy Policy.
Do not submit confidential information or material that belongs to someone else.
15. Updates, Availability, And Changes
Kiddos may update the App to improve safety, recognition, accessibility, design, performance, content, compatibility, subscriptions, or legal compliance. Quest packs, target lists, Reward Gallery thresholds or portraits, features, art, audio, and subscription availability may be modified, replaced, restricted, or removed.
The App may not work on every device, operating-system version, region, network, camera, Siri configuration, or accessibility setup. Some functions require Apple services or an internet connection, including purchases, restoration, entitlement synchronization, and external links.
We may suspend or discontinue all or part of the App. Where required by law, we will provide appropriate notice or remedies. We do not promise that a particular quest, target, score, best time, feature, or item of Content will remain available forever.
16. Accessibility
Kiddos aims to support accessible use and Apple accessibility settings, including larger text, VoiceOver, reduced motion, and device orientation where implemented. Needs and device configurations vary, and we do not guarantee compatibility with every assistive technology or setting.
A parent should decide whether camera-based gameplay and visual, audio, motion, or haptic feedback are suitable for the Child.
17. Suspension And Termination
You may stop using the App at any time. You can delete local quest history through Parent Controls and delete the App through iOS. Subscription cancellation must be completed separately through Apple.
Kiddos may suspend or terminate the license to use the App if you materially violate these Terms, misuse the App, threaten another person's safety or rights, attempt unauthorized access, or if suspension is reasonably required by law or platform rules.
Sections that by their nature should survive termination, including intellectual property, disclaimers, liability limits, dispute terms, and Apple-specific terms, will survive.
18. Disclaimer Of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE APP AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." KIDDOS AND ITS LICENSORS DISCLAIM EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, QUIET ENJOYMENT, AND COURSE OF DEALING.
KIDDOS DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR COMPATIBLE WITH EVERY DEVICE; THAT CAMERA RECOGNITION, SIRI, SCORES, REWARD GALLERY UNLOCKS, OR SUBSCRIPTION SYNCHRONIZATION WILL ALWAYS BE ACCURATE OR AVAILABLE; OR THAT EVERY QUEST WILL BE SAFE OR APPROPRIATE IN EVERY PHYSICAL SETTING.
THE DISCLAIMERS IN THESE TERMS DO NOT EXCLUDE WARRANTIES OR CONSUMER RIGHTS THAT CANNOT LAWFULLY BE EXCLUDED.
19. Limitation Of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, KIDDOS, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, GOODWILL, OR USE, ARISING FROM OR RELATED TO KIDDOS QUEST OR THESE TERMS, EVEN IF ADVISED THAT SUCH DAMAGES ARE POSSIBLE.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF Kiddos LLC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS AND SERVICE PROVIDERS, COLLECTIVELY, TO YOU AS THE ADULT ACCEPTING THESE TERMS, FOR ALL CLAIMS LEGALLY SUBJECT TO THESE TERMS ARISING FROM OR RELATED TO Kiddos Quest OR THESE TERMS WILL NOT EXCEED A FIXED AMOUNT OF THIRTY UNITED STATES DOLLARS (US $30). THIS CAP APPLIES TO FREE ACCESS AND, WHERE OFFERED, DIRECT PURCHASES OR SUBSCRIPTIONS, ACCESS THROUGH Kiddos+, AND ACCESS PERMITTED BY APPLE'S FAMILY SHARING OR VOLUME-PURCHASING RULES, REGARDLESS OF THE AMOUNT PAID OR THE APP THROUGH WHICH ACCESS WAS PURCHASED. IT IS ONE COMBINED LIMIT FOR ALL SUCH CLAIMS BY YOU UNDER THESE TERMS, NOT A SEPARATE LIMIT FOR EACH CLAIM, EVENT, DEFENDANT OR LEGAL THEORY, WHETHER IN CONTRACT, TORT OR OTHERWISE.
THE EXCLUSIONS AND LIMITATIONS IN THIS SECTION DO NOT APPLY TO LIABILITY OR REMEDIES THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED. DEPENDING ON APPLICABLE LAW, THESE MAY INCLUDE LIABILITY FOR FRAUD, WILLFUL MISCONDUCT, GROSS NEGLIGENCE, DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, AND VIOLATIONS OF MANDATORY CONSUMER RIGHTS. NOTHING IN THESE TERMS LIMITS A CHILD'S INDEPENDENT CLAIM THAT IS NOT LEGALLY SUBJECT TO THESE TERMS.
This section does not restrict refund rights under applicable law or Apple's applicable refund and warranty policies. It concerns Kiddos Quest and does not set a liability limit for claims arising solely from another Kiddos app. The stated limit does not establish liability or entitle anyone to a payment. Some jurisdictions do not allow certain exclusions or limitations, so part of this section may not apply to you.
20. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold Kiddos and its affiliates, officers, directors, employees, agents, and licensors harmless from third-party claims, losses, liabilities, and reasonable costs, including reasonable legal fees, but only to the extent caused by your unlawful or unauthorized use of the App, your material violation of these Terms, or your infringement of another person's rights. This includes your deliberate bypass of safety controls or knowing permission of prohibited use, to the extent that conduct causes the third-party claim or loss. Changing a parent setting as expressly permitted by these Terms is not, by itself, misuse or a material breach.
This section does not require indemnification for Kiddos's own negligence, misconduct, or violation of law and does not limit rights that cannot legally be waived. It cannot be used to require you to reimburse Kiddos for a Child's claim where doing so would circumvent a legally protected right. A good-faith safety report or exercise of a non-waivable legal right does not itself create an indemnity obligation.
21. Governing Law And Disputes
Before filing a claim, you and Kiddos agree to make a reasonable good-faith effort to resolve the issue informally by contacting contact@kiddos.ai. This does not prevent either party from seeking urgent relief or using a consumer-protection process, and it does not extend or waive a legal limitation period.
Except where mandatory local law provides otherwise, these Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any court proceeding that is not required by law to occur elsewhere will be brought in a state or federal court located in Santa Clara County, California, and you and Kiddos consent to that court's jurisdiction.
Nothing in these Terms deprives a consumer of mandatory protections or the right to bring a claim in a court or forum that applicable law requires to remain available.
22. Apple-Specific Terms
If you obtained the App through Apple's App Store, you and Kiddos acknowledge and agree that:
- these Terms are between you and Kiddos, not Apple;
- Kiddos, not Apple, is solely responsible for the App and its Content, subject to these Terms;
- Kiddos provides any maintenance or support required by these Terms or applicable law; Apple has no obligation to provide it;
- if the App fails to meet an applicable warranty, you may notify Apple for a refund of the App's purchase price; Apple will provide that refund under its minimum developer-license terms. Any remaining warranty responsibility and associated claims, losses, or costs belong to Kiddos to the extent required by law, and Apple has no further warranty obligation to the extent the law permits;
- Kiddos, not Apple, is responsible for addressing claims relating to the App, including product-liability, legal-compliance, and consumer-protection claims;
- Kiddos, not Apple, is responsible for investigating, defending, settling, and resolving a claim that the App infringes a third party's intellectual-property rights;
- you represent that you are not located in a country subject to a United States government embargo or designated as a terrorist-supporting country and are not listed on a United States government prohibited or restricted-party list;
- you must comply with applicable third-party terms when using the App; and
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the Apple-specific provisions against you.
Apple's minimum terms and applicable Apple Media Services terms also apply:
https://www.apple.com/legal/internet-services/itunes/dev/minterms/
23. General Terms
Assignment
You may not transfer these Terms or the license without Kiddos's prior written consent. Kiddos may transfer these Terms as part of a merger, reorganization, financing, sale of assets, or transfer to an affiliate or successor, subject to applicable law.
Severability
If a provision is found unenforceable, it will be enforced to the maximum lawful extent or modified as little as necessary, and the remaining provisions will continue in effect.
No Waiver
Failure to enforce a provision is not a waiver of the right to enforce it later.
Entire Agreement
These Terms, the Privacy Policy, Apple's applicable terms, and any additional terms displayed for a specific purchase form the agreement concerning the App and replace prior agreements about the same subject.
Headings
Headings are for convenience and do not change the meaning of these Terms.
24. Changes To These Terms
We may update these Terms to reflect App changes, safety improvements, legal requirements, or platform rules. The revised Terms will show a new "Last Updated" date.
When a change is material, we will provide notice in the App or by another method required by law. We may ask the adult to review and accept revised Terms before continuing. Changes do not retroactively reduce rights that cannot legally be reduced.
If you do not agree to revised Terms, stop using the App and cancel any active Subscription through Apple.
